이 죄인을 완전케 하옵시고 / 하시옵고 (통 215 / 새 426) cppyright dispute

찬송가에 설명을 보면 W. G. Fischer 작곡으로 1872 년 곡이라고 하니 당연히 copyright 기한이 소멸된 곡으로 판단하여 dispute 했다. Copyright summary and status 내용을 보면 Más blanco que la nieve라는 노래의 멜로디를 사용했다고 하면서 Interstreet Publishing이라는 곳이 copyright 소유하고 있다고 하는데, 말도 안 되는 소리다.

이 곡은 William G. Fischer 작곡으로 'Whiter than Snow'라는 영어 제목으로 불리고 있는 것 같다. James L. Nicholson 작사한 찬송가 내용도 보면 우리 가사와 유사하다. (https://hymnary.org/tune/lord_jesus_i_long_to_be_perfect_fischer 참조)

상황이 이러하므로 YouTube 통해서 자신의 저작권을 주장하는 곳은 잘못 claim 했다고 판단하고, YouTube Studio 통해서 아래와 같이 dispute 했다.

1. Ristriction 부분의 Copyright claim 표시된 곳에 마우스를 위치한 후 SEE DETAILS 선택

2. Actions 부분에 SELECT ACTION 메뉴 가운데 Dispute 선택

3. 'My dispute isn't based on any of the reasons above. I would still like to dispute this Content ID claim.' 체크한 후 CONTINUE 선택

4. PUBLIC DOMAIN (The content claimed in my video is in the public domain and is no longer protected by copyright.) 체크한 후 CONTINUE 선택

5. 'The content claimed in my video is in the public domain, or isn't protected by copyright for another reason.' 체크한 후 CONTINUE 선택

6. 이제 'Why is this content in the public domain? (required)' 질문에 답해야 한다. 앞서 조사한 내용에 근거하여 아래와 같이 설명했다.

"This hymnal song titled 'Lord Jesus, I long to be perfectly whole' is composed by William G. Fischer in 1872. The composer passed away in 1912. It is in public domain and my video does not infringe anyone's copyright."

7. 이후 아래 3 가지 질문에 모두 체크한 후 서명(first and last name)해야 하고, SUMMIT 선택

- 'My video does not infringe anyone's copyright.'

- 'I understand that the claimant will be able to review my video and my dispute rationale.'

- 'I understand that filing fraudulent disputes may result in termination of my YouTube account.'

만만한 내용이 아니다. 최악의 경우 허위로 신고할 경우 YouTube 계정 폐쇄로 이어질 수도 있다는 것이지만 이미 조사를 통해서 자신할 수 있다면 무엇이 두려우랴.

8. 이제 이 내용은 copyright 주장하는 사람이 30 일 이내에 검토한다고 한다. (Disputes will be sent to the claimant for review. YouTube does not review Content ID disputes. The claimant now has 30 days to review your dispute. We'll send you an email to let you know the outcome.)

 

이틀 만에 아래와 같은 결정 통보를 받았다.

"Good news! After reviewing your dispute, Interstreet Publishing has decided to release their copyright claim on your YouTube video."
